Terms & Conditions

SUMMARY:
We understand that legal jargon can be overwhelming, so here's a brief overview of the key points. However, keep in mind that the full Terms and Policies are what govern your ticket purchase, not this summary. These points are provided for convenience only.

  • Ticket prices may exceed face value.
  • All sales are 100% final, no refunds, exchanges, or cancellations are possible after the receipt of the booking.

  • We provide a 120% Order Guarantee for ticket delivery.

  • Tickets may not be delivered immediately but are guaranteed to arrive before the event.

  • If original tickets are unavailable, your order may be upgraded with equal or better ones.

  • If an event is postponed, your tickets remain valid for the rescheduled date (no refunds for postponements).

  • If an event is canceled, you'll receive a full refund for your booking.

  • Your order is only a request until it's confirmed by the ticket suppliers (seller). Once confirmed, our order guarantees apply.

  • We are not liable for lost or stolen tickets, delivery errors, issues caused by third parties (for example ticket sellers or weather), or travel expenses.

TERMS & CONDITIONS:

The terms provided describe the key rules and policies governing the use of our website ("SITE") and the process of purchasing tickets through the platform. Here are the main points:

  1. Our Role:
The SITE acts as a marketplace, connecting buyers with third-party ticket sellers but is not involved in the actual sale transaction between them.

  2. Ticket Prices:
Tickets sold on the SITE often come from the secondary market. Prices are set by the ticket sellers and can be higher or lower than the face value of the ticket.

  3. All Sales Are Final:
There are no cancellations, returns, or exchanges once a ticket order is confirmed.

  4. Event Cancellation:
If an event is canceled, the buyer is entitled to a full refund, minus any delivery fees (if tickets were already delivered).

  5. Postponed or Rescheduled Events:
If an event is rescheduled and the original tickets remain valid, buyers cannot request a refund.

  6. Name on Tickets:
Since tickets come from third-party sellers, the buyer’s name will not appear on the tickets. This will not affect the buyer's ability to attend the event.

  7. Buyer Guarantee:
In the rare event that valid tickets are not delivered in time, the buyer is guaranteed a 120% refund.

  8. Comparable Tickets:
If the original tickets ordered are unavailable, comparable or upgraded tickets may be provided.

  9. User Agreement:
By using the SITE or purchasing tickets, users agree to follow the terms and applicable laws. The SITE reserves the right to update the terms at any time and take action, including canceling orders or blocking users, if the terms are violated.

This policy emphasizes the marketplace nature of the site, where transactions are final and ticket availability may vary due to third-party involvement.

ALL SALES ARE FINAL:

This additional section further clarifies the terms regarding ticket purchases, event changes, and cancellations on the SITE:

  1. No Refunds, Exchanges, or Cancellations:
Once a ticket is purchased, the sale is final. Tickets are considered unique and irreplaceable, so there are no refunds, exchanges, or cancellations.

  2. Postponed or Rescheduled Events:
If an event is postponed or rescheduled, the original tickets will still be valid for the new date. In rare cases, new tickets may be required, and the buyer will be contacted by the ticket seller (referred to as the "SUPPLIER").

  3. Canceled Events:
If an event is canceled with no rescheduled date, the buyer must contact the SITE for a refund. The SITE may ask the buyer to return the original tickets at the buyer’s expense.

    • Shipping and handling charges are not refundable.

    • Refunds will be processed in the same currency used for the original purchase, and any currency conversion fees (such as bank fees) are not covered by the SITE or the SUPPLIER.

  4. No Refunds for Lost, Stolen, or Damaged Tickets:
Neither the SITE nor the SUPPLIER will issue refunds or exchanges for tickets that are lost, stolen, damaged, or destroyed. Buyers are advised to store their tickets securely.

ABOVE FACE VALUE:

This section elaborates on ticket pricing, the role of the SITE, and the nature of tickets sold through the platform:

  1. Secondary Market Resale:
Tickets sold through the SITE are often sourced from secondary market ticket sellers, which means they are being resold. In many cases, the resale price will be higher than the original face value of the ticket, although it could also be lower.

  2. Service Charges and Handling Fees:
All ticket prices shown on the SITE include additional service charges and handling fees, which are defined for each order. These are separate from the face value of the ticket.

  3. No Direct Affiliation:
The SITE and the ticket sellers are not affiliated with performers, sports teams, or venues unless explicitly stated. The SITE does not serve as a primary box office unless specifically noted.

  4. Acknowledgment of Price Differences:
By accepting the terms, users acknowledge that the purchase price on their order may differ from the original purchase price of the ticket. It may be higher or lower than what was originally paid for the ticket.

This section ensures that users understand they are often purchasing tickets on a secondary market where prices may vary significantly from the original price, and the SITE is independent from official ticketing outlets or event organizers.

TICKET AVAILABILITY:

This section outlines the limitations and procedures regarding ticket availability, particularly when tickets are sourced from third-party sellers:

  1. Ticket Availability Not Guaranteed:
The SITE cannot guarantee that tickets will be available until the buyer (USER) physically receives them. Even if a ticket is listed on the SITE, its availability may change before the order is fulfilled.

  2. Unique Ticket Listings:
Most ticket listings on the SITE represent unique sets of tickets provided by individual ticket sellers. However, some listings may only represent available ticket options or offers to procure tickets rather than exact seat locations or tickets that are immediately available.

  3. Ticket Unavailability:
Occasionally, tickets ordered may no longer be available at the price or in the quantity requested when the order is processed. In such cases:

    • If similar or better seats are available at the same price, the ticket seller will provide these alternative seats to fulfill the order.

    • If no equivalent or better options are available, a full refund will be issued if the charge was already made. The user will also be notified that their ticket request has been rejected.

This section highlights the potential for changes in ticket availability and ensures that users are either provided with equivalent alternatives or fully refunded if their original tickets are not available.

ORDERS:

This section outlines the order fulfillment process and the responsibilities of the user when placing an order through the SITE:

  1. Order Fulfillment:
Orders placed through the SITE will be fulfilled by one of the participating ticket sellers in the SITE's network (referred to as the "SUPPLIER").

  2. Responsibility for Information Accuracy:
Users are required to carefully enter all necessary information when submitting an order. They are responsible for any errors made during this process. Such errors could lead to:

    • Delays in processing the order.

    • Delays in the delivery of tickets.

    • Cancellation of the order.

This section emphasizes the importance of accuracy when submitting order details and provides a pathway for users to seek assistance if they encounter issues or need to retrieve order information.

ZONE TICKETS / TICKETS NOT IN HAND:

This section describes the policy regarding "Zone Tickets" or tickets marked as "not in hand," which are available for certain live events:

  1. Pre-Approved Sellers:
A limited number of pre-approved ticket sellers are allowed to offer tickets for sale that they do not currently possess.

  2. Zone Tickets:
These tickets may be labeled as "Zone Tickets" or marked as "tickets not in hand." When purchasing these tickets, the seller commits to obtaining the specified tickets for the buyer upon receiving the order.

  3. 120% Money Back Guarantee:
Like all tickets sold on the SITE, Zone Tickets are covered by a 120% Money Back Guarantee. This guarantee assures buyers that:

    • After placing an order, once it is confirmed by the seller, the tickets will be located within the designated area specified in the listing or in a comparable or better location.

    • Buyers will receive their tickets in time for the event. If this does not happen, buyers are entitled to a 120% refund.

This section provides reassurance to buyers purchasing tickets that are not currently held by sellers, ensuring that they will receive tickets as promised or receive their money back if the seller fails to fulfill the commitment.

PRICING:

This section outlines the pricing policies and procedures related to orders placed through the SITE:

  1. Currency:
All prices for products and services listed on the SITE are in United States Dollars (USD) unless explicitly stated otherwise.

  2. Price Confirmation:
The SITE cannot confirm the price for any products or services until the order is completed by the user (USER).

  3. Pricing Errors:
Despite the SITE's efforts to maintain accurate pricing, some products and services may be listed at incorrect prices. In the event that the ticket seller (SUPPLIER) discovers that the correct price is higher than the price listed on the SITE, the following actions may occur:

    • The order will be completed at the original stated price.

    • The SUPPLIER will contact the USER to inform them of the correct price and offer them the option to proceed with the purchase at that new price.

    • The USER’s order may be canceled, and the USER will be notified of the cancellation.

This section clarifies the SITE's position on pricing discrepancies and ensures that users are aware of the potential for errors in ticket pricing, as well as their options if a discrepancy arises.

FEES:

This section details the fees and charges associated with purchases made through the SITE, as well as the responsibilities regarding taxes for ticket sellers:

  1. Fees and Charges:
The total amount charged to the user's credit card will include several components beyond the price of the individual tickets:

    • Service Fee: This fee covers the operational costs of the SITE, including customer service, obtaining tickets on behalf of the user, and other fulfillment-related expenses.

    • Delivery Fee: This cost is based on the delivery method chosen by the user and the arrangements made by the SITE for ticket delivery through the SUPPLIER.

    • Total Amount: This is the entire amount charged to the user, which includes the price of each ticket as set by the SUPPLIER, the service fee, and the delivery fee.

  2. Tax Responsibilities:

    • The ticket seller (TICKET SELLER) is responsible for staying informed about any changes to tax withholding requirements and amounts in various jurisdictions where tickets are sold.

    • The TICKET SELLER must determine whether any taxes are due for sold tickets. In states where the SITE has indicated that it will collect certain taxes, the TICKET SELLER does not need to handle tax collection for those transactions.

    • For other states, the TICKET SELLER must include any applicable sales, use, excise, service, and other taxes in the ticket price.

    • The TICKET SELLER must provide the SITE with any necessary information to report payments made to them to tax authorities, which may include their employer identification number, social security number, or tax ID number. The TICKET SELLER authorizes the SITE to release this information to the relevant tax authorities.

This section emphasizes the breakdown of charges associated with ticket purchases and outlines the responsibilities of ticket sellers regarding tax compliance and reporting.

PAYMENTS:

This section covers the payment processes, responsibilities, and security measures related to credit card and other forms of payment for orders placed through the SITE:

1. Credit Card Charges:

  • Charge Responsibility: The user's credit/debit card will be charged by the SITE at the time of booking.

  • Inquiries: If the user has questions about charges on their credit card statement, they should contact either the SITE at given contact details.

  • Pre-Authorization: The SITE will charge or authorize the user's credit card in advance of confirming ticket availability. If the tickets are ultimately unavailable, the user's credit card will not be charged, or they will receive a full refund for any amount charged.

2. Payment by Debit Card:

  • Multiple Authorizations: In some instances, the SITE may attempt to authorize a debit card multiple times, which could result in several holds on the user's account. This typically occurs due to third-party credit card processing companies requiring additional security verification or if the user's information is incorrectly entered.

  • Temporary Holds: While the SITE will only process the transaction once, these holds may temporarily lower the user's available balance and can take several days to clear.

3. Collecting Payment for Orders:

  • Payment Collection: Users agree that the SITE has the right to collect payment for any order once the items are shipped.

  • Errors and Charges: If a third-party provider or system error results in an unprocessed payment (meaning the user’s payment card is not charged despite the items being shipped), the user authorizes the SITE to collect the due amount through any appropriate means, unless prohibited by law.

  • Responsibility for Costs: Users are responsible for any legal fees or collection costs incurred by themselves, the SUPPLIER, or the SITE in relation to payment collection. The SITE and SUPPLIER will not bear responsibility for these costs.

4. Security of Cardholder Data:

  • The SITE and the SUPPLIER are responsible for the security of any cardholder data they possess or store, process, or transmit on behalf of the user.

This section emphasizes the user's responsibilities regarding payments and clarifies the security and processing protocols in place for transactions made through the SITE.

International Orders:

  • Delayed Processing: International orders may experience delayed processing. The SITE recommends that users placing orders from outside the U.S. contact their credit card company or financial institution before placing an order to avoid delays or holds.

  • Responsibility: Neither the SITE nor the SUPPLIER is responsible for any delays, holds, or additional fees associated with international orders.

Disputed Charges:

  • Authorization: By placing an order, the user authorizes the SITE to charge their payment method for the full amount, including the ticket price, service and delivery fees, and any optional services.

  • Dispute Outcomes: If the user disputes a charge and it is found that the charge was valid and not the result of payment fraud, the SITE reserves the right to seek payment using appropriate means, such as collection agencies or legal action.

  • Ticket Relisting: The SITE may relist tickets that are the subject of a payment dispute to mitigate damages.

  • Access Loss: Users may lose access to their tickets if they file a dispute with their payment provider.

Event Listings:

  • Accuracy: The SITE does not guarantee the accuracy of event information, including event name, location, start time, or date. Event start times and details may change without notice.

  • Changes by Third Parties: Event changes, such as location, date, time, performer list, or ticket package amenities, are at the discretion of the event organizer (e.g., venue, performer, or promoter). The SITE is not responsible for such changes.

  • User Responsibility: Users are advised to visit the event organizer's website to confirm any updates to event details, such as time adjustments.

Ticket Holder Behavior Policy:

  • Venue Rules: The user agrees to comply with the rules and policies of the event venue regarding conduct and behavior. Failure to do so may result in ejection or denial of entry.

  • Ejection Penalties: If a user is ejected or denied entry, they will be responsible for any fines or legal expenses related to the incident. Additionally, ticket costs will not be refundable.

  • Liability for Losses: If the user's ejection results in the ticket seller losing rights to use or purchase other tickets (such as season tickets), the user will be held liable for all associated costs, expenses, and losses, including direct, indirect, and punitive damages.

Fraudulent Use:

  • To protect against fraud, users may be required to provide additional proof of identity when placing an order. This may include:

    • A signed credit card authorization.

    • Photocopies of public documents, such as a driver's license or passport.

Delivery:

  • Delivery Method: Orders are delivered using the method chosen by the user. In some cases, shipping may be upgraded without prior notice to the user, however the user will not be charged for the upgraded shipping.

  • Processing Time: Most orders are shipped at least 3-7 days before the event.

  • Signature Required: Shipments may require a direct signature at the point of delivery.

  • Correct Shipping Address: Users are responsible for providing the correct shipping address at the time of purchase. If an incorrect address is provided, refunds will not be issued.

  • Tracking: Users should contact the seller or SITE customer support if they have not received tracking information after purchase.

Delayed Shipment:

  • Immediate Delivery Not Guaranteed: While tickets are generally delivered according to the selected delivery method, some situations may cause delays. These include:

    • Purchasing tickets far in advance of an event.

    • Delays caused by the performer, venue, or team.

  • Estimated Ship Date: Tickets may have an estimated ship date. Users can track the status of their order through the account access information provided after purchase.

  • Expedited Delivery: Selecting an expedited delivery option does not guarantee immediate shipment.

International Shipping:

  • Users located outside the United States must select an International Delivery option.

  • If a domestic shipping option is selected for an international order, the shipping cost will be adjusted to the International Rate after the order is placed.

Delivery Verification:

  • Non-Verifiable Addresses: If the user specifies a shipping address that does not allow for delivery verification (e.g., a P.O. Box), additional fees may apply. The user will be contacted about the fee or the order may be canceled.

  • Responsibility for Receiving Package: It is the user's responsibility to receive the package. If the package is refused, undelivered, or returned, no refunds or credits will be issued due to the "All Sales Are Final" policy.

E-Ticket Download:

  • Immediate Download Not Guaranteed: Even for electronic tickets labeled as "Instant," availability for immediate download is not always guaranteed. Some "Instant" e-tickets may be downgraded to regular e-ticket downloads due to fraud concerns, which requires additional processing.

  • Email Notification: After placing an order, users will receive an email with instructions for downloading tickets. Providing an accurate email address is essential for this process.

  • Credentials and Printing: Users will need order-specific credentials to access the tickets and must have access to a printer to print them.

  • Contact Support: Users are responsible for reaching out to customer support if they do not receive the email, cannot download the tickets, or cannot print them. Refunds will not be issued for providing incorrect email information or failure to print tickets.

Electronic Transfer:

  • Immediate Access Not Guaranteed: Some electronic transfers may not be available for immediate access. Users will receive an email with instructions on how to accept the ticket transfer.

  • Account Creation: To access the tickets, users may need to create an account with the associated ticket transfer system and must have a smart device to present the QR code for entry to the event.

  • Responsibility for Email and Transfer: Users are responsible for ensuring they provide the correct email address and must contact support if they don’t receive instructions or are unable to locate the transfer email. Refunds will not be issued for failure to provide a correct email address or accept the transfer.

  • Declining Transfer: Refunds will not be issued if the user declines the ticket transfer.

Local Delivery:

  • Pick-up Location: Tickets must be picked up from a designated location near the event venue. Users must bring a government-issued ID to claim the tickets, and they may also be asked to present the credit card used for purchase as further verification.

  • Failure to Pick Up: Refunds will not be issued if the user fails to provide the required documentation or does not pick up the tickets from the designated location. Users should contact the SITE if any issues arise at the pick-up location.

Denied Entry to an Event:

  • Contact SITE: If a user is having difficulty gaining entry to an event, they should immediately contact SITE at contact numbers. If SITE cannot resolve the issue and the user is denied entry, the user may be eligible for a refund.

  • Proof of Denied Entry: To qualify for a refund, the user must obtain written proof from the venue showing that entry was denied. This written proof, along with a description of the circumstances, must be emailed to SITE within five (5) working days of the event.

  • Refund Investigation: SITE will investigate the claim and, if it is determined that the user was denied entry, SITE will refund the cost of the tickets, all associated fees, and shipping charges. This refund is the user’s sole remedy for denied entry.

Permitted Use:

  • Personal Use Only: Users are only allowed to visit and view the site for personal use, such as reviewing event information, purchasing tickets, or personal merchandise. Users cannot duplicate, download, publish, modify, or distribute the material on the site for any other purpose unless specifically authorized.

  • Prohibited Automated Use: Users may not use any automated systems (robots, spiders, scrapers, etc.) to search for, buy, or obtain tickets. Additionally, users are not allowed to introduce any malicious software (viruses, worms, etc.) that could damage the site.

  • Intellectual Property: The content and software on the site are protected by U.S. and international copyright laws, and users must respect these intellectual property rights.

Violation of Terms:

  • Termination of Access: SITE reserves the right, at its sole discretion and without prior notice, to terminate a user's access to the site, cancel orders, or take other actions if the user violates the terms and conditions.

  • Equitable Relief: Monetary damages may not be sufficient to compensate SITE for violations, and SITE may seek injunctive or other equitable relief in addition to other remedies.

  • Release of Information: If required by law or necessary to prevent unlawful or harmful activities, SITE may release user information to address such matters.

  • No Refund for Termination: If a user is terminated for violating the terms, they are not entitled to a refund.

Intellectual Property Information:

  • Content Ownership: All content (e.g., information, software, graphics, etc.) on the SITE is protected by copyrights, trademarks, patents, or other proprietary rights, and is the sole property of SITE or its affiliates. Content includes message boards, chat, and original content.

  • No Liability for Third Parties: SITE is not liable for actions or omissions of third-party users, advertisers, sponsors, or anyone associated with products and services connected to the site.

Limitation on Liability:

  • SITE as a Marketplace: SITE functions as a venue where users buy and sell tickets, but it is not involved in the actual transactions between buyers and sellers. It cannot guarantee the accuracy of listings or the completion of transactions.

  • Liability Limitation: If SITE or the third-party provider is found liable, their liability is limited to the greater of (a) any amounts due under SITE’s limited guarantee (when applicable), (b) the disputed fees, not to exceed the total fees of the transaction.

  • No Liability for Indirect Damages: SITE and PROVIDER will not be liable for indirect, consequential, or punitive damages, including lost profits, even if they have been advised of the possibility of such damages.

Indemnity:

  • The USER agrees to indemnify and hold SITE, its affiliates, employees, and partners harmless from any claims, losses, or damages, including legal fees, arising from USER'S use of the SITE. This includes situations where the USER uploads content, provides links, or otherwise interacts with the SITE.
